This website is operated by YELLOWXCLOTHING ("we", "us", "our"). By visiting this site or placing an order, you agree to the terms set out below. Please read them.

Using this site

You must be at least the age of majority in your province, state or country to purchase from us, or have the consent of a parent or guardian. You agree not to use this site for any unlawful purpose, to attempt to gain unauthorised access to it, or to interfere with its operation.

Our products

Everything we sell is pre-owned and second-hand unless a listing states otherwise. Each item is a single piece — one of one. Items are sold as-is in the condition described and photographed, and carry a condition grade from 1/4 to 4/4 explained in our Refund Policy.

We photograph and describe every item as accurately as we can. Colours can vary between screens, and normal signs of age and wear consistent with a stated condition grade are expected on second-hand goods.

Brand names, logos and trademarks appearing in listings belong to their respective owners. We are an independent reseller and are not affiliated with, endorsed by, or sponsored by any of the brands we resell.

Pricing and payment

All prices are in Canadian dollars (CAD) and are subject to change without notice. Applicable taxes and shipping are calculated at checkout.

We reserve the right to refuse or cancel any order, including where an item has been listed at an incorrect price, is no longer available, or where we suspect fraud. If we cancel an order after payment, you will be refunded in full.

Orders

Your order is an offer to buy. A contract is formed when we confirm and ship your order. Because every item is unique, availability is not guaranteed until checkout is complete — if two orders are placed for the same item, the first completed checkout takes it, and the other is refunded in full.

Shipping and risk

Shipping timeframes, rates and responsibilities are set out in our Shipping Policy, which forms part of these terms. Delivery estimates are carrier estimates and not guarantees.

Returns and refunds

Our Refund Policy forms part of these terms. In short: all sales are final because every item is one of one, with exceptions where an item is not as described, is damaged in transit, is the wrong item, or never arrives.

Accuracy of this site

We work to keep information on this site accurate and current, but we do not warrant that product descriptions, pricing, availability or other content is error-free or complete. We may correct errors and update information at any time without notice.

Third-party links and services

This site may link to third-party websites and uses third-party services including Shopify for hosting and payment processing. We are not responsible for the content, policies or practices of third parties. Your use of those services is governed by their own terms.

Disclaimer of warranties

Except as expressly stated in these terms or required by law, this site and everything sold through it is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential losses.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including your rights under applicable consumer protection legislation.

Indemnity

You agree to indemnify and hold us harmless from any claim or demand arising out of your breach of these terms or your violation of any law or the rights of a third party.

Personal information

Your personal information is handled in accordance with our Privacy Policy.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict of law principles. This does not deprive you of the protection of mandatory consumer protection laws in your own country of residence.

Changes to these terms

We may update these terms at any time by posting a revised version on this page. The version in effect at the time you place an order is the version that applies to that order.
